He warned that her case might be dismissed if she didn't file an appropriate statement of claim within 21 days. Rinehart's legal team, led by Charles Colquhuon, SC, attempted to have their client and her companies removed from the proceedings, arguing they don't own the property. But this move was swiftly rejected by the court. Similarly, a request to move the case to the equity division was also denied, with Justice Hammerschlag humorously suggesting it might strain his friendship with Judge Ian Pike.
At the heart of this dispute is not just a fence in need of repair but the movement of animals between the two farms. Pope claims she has lost a staggering 800 animals, including cattle, sheep, deer, goats, and even guardian dogs, over the past seven years due to inadequate fencing. Rinehart's side, however, has concerns about animal movement, feral goats and pigs, and the potential for disease.
Rinehart's office has remained tight-lipped, but Pope's claims against the billionaire have been disputed. The situation is further complicated by Pope's arrangement with her other neighbor, Mary Kakaroubas, where Pope agists her animals in exchange for fence and trail maintenance. Kakaroubas has joined Pope in this legal battle.
Justice Hammerschlag advised Pope to seek legal representation and appear in court in person if the case proceeds to a hearing. He emphasized the challenges Pope faces, stating, "Even with the best will and case, the brief you've provided is not sufficient." Pope, however, remains determined, having contacted over 45 legal firms and exhausted all government resources.
Pope's words are a stark reminder of the challenges faced by those without means in the legal system: "They've all said I have a case, but the reason for not taking it is the disparity between the parties."
